Have you ever been caught picking your nose by a stranger, then called out on it? no, i think most people are too polite to call a stranger out on something like that. most of us have the decency to recognize that someone else would be needlessly embarrassed so we refrain from causing that discomfort.

When an Email is sent to the wrong person, and it contains a paragraph warning that the "transmission is attorney privileged & confidential," does the UNINTENDED recipient actually have any obligation to maintain confidentiality? legally, i would think not, because the warning was intended for someone else and it's not like you signed anything. but, it's probably still nice to be confidential if no one could get hurt about it.
