Leagalize it, but for private home use only. It has already been proven that cigs and alcohol are more dangerous, and anyway it is ridiculous to punish someone for something they do to their own body. If used safely in ones home, it would be fine.

Go back up the stairs and use the hang glider from the first building. You can also get a walkthrough on www.gamefaqs.com I don't really remember what to do but I'm pretty sure it will be okay if you go back up the spiral stairs from the first building.
