What can you do if the Non Custodial Parent (MOM) refuses to do her overnight visitation with her child. It is a court order that she see's her Mom. Father is willingly able to drop off and pick her up.But mom refuses , but doesnt have a car or a job, So there is NO schedule. It shouldnt be a problem. What can we do to modify this in court? The mother (non custodial parent) also smokes around this child who is 4, and has asthma, and just got off her nebulizer. It is causing many kinds of damage for this little girl. She is harming her daughter physically by smoking in the only bathroom at her trailer. ( So its not big, neither is the window she has open when she smokes). What can we do To get rid of a Spiteful mother, who doesnt call to see her daughter, and refuses atleast 2 times a month to see her. She goes out of state to West Virgina 2 weeks ago. but can't manage to find the time to see her daughter 10 minutes from her home. Help? Advice?

Is a written agreement outside of court enforcable? I will be going to court, but need an agreement in the meantime.
