My new neighborhood (in georgia) has 12/36 propertys sold. Per the covenants any lot/home owner has to pay the yearly home owner assoc. assessment. The builder owns the remaining unsold 24 lots. Shouldn't the builder be paying the same assessment?

We rented our home in Phoenix in January 08. In May of 08 the HOA Board decided to pass a Lease/Rental Agreement which requires the homeowner to pay $75 to have the HOA process and register the tenant as a renter. Are we grandfathered in?

As well as a fine, in CA, if a homeowner is over 3 months late in their Assoc. fee, can the Assoc. shut off their water, as that is part of the fee? Also, can we post their name, or is only the Assoc. Board allowed to know who is not paying? $38,000 due.
