Rights When Renting a Car

InstructionsHonoring a ReservationStep 1: When a reservation is made, the renter has the right to demand the car she reserved at the time she reserved it. If the car is not there, the rental car company has the responsibility to accommodate the renter. Some methods of accommodation are complimentary upgrades to a higher car class, or a percentage off the rental once a car becomes available. However, the rental car company does not have to hold a car beyond a grace period, which is generally 15 to 30 minutes. If the renter knows she is going to run late, she should call the rental car company and let the representative know she is running late.
Right to Purchase InsuranceStep 1: When renting a car, if a person has his own full-coverage auto insurance policy, he does not have to purchase extra insurance to rent a car. The renter has the option to purchase insurance from the rental car company. There is a fee, which varies with each rental car company, to use the company's insurance plan. If a person does not have full-coverage insurance, some rental car companies require a renter to purchase the insurance. A renter also has the right to deny purchasing insurance from the rental car company if he has a major credit card that provides car renter's insurance.
Right to Roadside AssistanceStep 1: If a rental car breaks down or has any other repair issues, the renter has the right to roadside assistance. Each rental car has a roadside assistance policy. Some rental car companies have agents that come out to assist the renter, while others that aren't franchised like Avis, Enterprise or Budget have automobile repair companies they contract with to help the with repairs such as oil changes, flat tires or lockouts.
Coupons and DiscountsStep 1: A renter with a valid coupon has the right to use that coupon on a rental. If the coupon applies to the rental car class, is not during a blackout and has not expired, the rental car company must honor the coupons they have advertised. If a rental car agent does not honor a valid coupon, the renter should contact the rental car company's customer service department. Generally the customer service department can access the paid-out rental agreement and adjust the bill over the phone.
Right to Out-of-State TravelStep 1: A renter has the right to travel outside of the state with the rental car she has rented, if the company policy permits so. The pricing for out-of-town rentals may be higher because of mileage allowances. A renter who is traveling outside of the state should notify the rental car company of this in case their policy does not permit out-of-state rentals. If an accident occurs and the car was taken out of town illegally, the rental car can be reported stolen.
