Federal Law

  • Step 1:
    Under federal law, it is illegal to possess marijuana. Narcotics that are prohibited by the federal government are listed under the Controlled Substances Act, and marijuana is on that list.

Federal Penalties

  • Step 1:
    Possession of 1 kg or less of marijuana is subject to probation but there is no prison requirement. A person found with more than 1 kg of marijuana may be sentenced to prison.

State Law

  • Step 1:
    In our federal system of government, the states may pass different laws regarding marijuana possession. They may prohibit, legalize or partially legalize marijuana possession.

California Laws

  • Step 1:
    Possession of less than 1 oz. of marijuana permits penalty of approximately $371. Possession of more than an ounce is subject to maximum six months jail and $500 fine.

Conflicts of Laws

  • Step 1:
    The federal government may prohibit possession of marijuana for all purposes, including medical purposes. States need not conform to federal law and may permit possession of marijuana.
