Unemployment denying benefits...is this legal?

My brother in law had given his 2 week notice at a previous job here in New York. It was never handed up to the employer. He then received a letter of termination. Unemployment has denied him benefits because his employer wrote that he had resigned for "a better paying job." This was not true. Can unemployment legally deny him of benefits?

    Ok, you say that he had given his 2 week notice then you say it was never handed to the employer; Which is it? This is the important part, because if he can't prove that he was terminated, his employer can protest benefits, and yes, unemployment can deny him benefits if he terminated the employment.
