im sorry to hear about ur brother, are you asking because you want to know if you have a legal right to them? if they were married when he died then they are hers to do with as she wishes. let her grieve before you start hitting her up for their property.
Currently, 2011, do you need to have a small estate affidavit notarized in Illinois? I think this may have been a recent change.
