Well, I speak as a person who has gone through two DUI's...
The first I got in the state of Iowa was an OWI (operating while intoxicated)... I blew a .452 (legal limit .08).... I was 19 ... I got it 8/16/07... I just finished paying off the fine yesterday (quite literally)... My fine was only $2,400 plus court costs, I lost my license for 6 months, and was jailed for 120 days...

The second I got in the state of Ohio and it was a DUI (driving under the influence)... I had not been drinking but my drug test came back positive for marijuana... I don't smoke and hadn't for over a year and half... My THC level was 24 (for those who know that is not high and is trace amounts, the equivelant of a contact high)... The passengers in the car were smoking pot, and because i happen to breath the same air as them i got a DUI... It is my fault for allowing them to smoke... I spent 3 days in jail and have a $1,200 fine...

I think the laws should be a case by case... My first I do not feel the punishment fit the crime... The fine should have been higher, the jail sentence longer, community service should also have been assigned (I believe 200 hours is sufficient) and the license suspended for a year... The second though, I understand that jailing me is correct... A fine yes... But I don't believe that I should have gotten a DUI... I had no other drugs or alcohol in my system, and it wasn't as if i was high... It was a contact and is the equivelant af less than one hit of the stuff...

Should laws be harsher? Yes... Case pending... The reason these are issued is not just for the safety of yourself, but fo r the safety of everyone else... When we get behind the wheel, It is no different than going in public with a loaded gun... How and what you choose to do with them is up to you... But when you impair yourself and choose to drive... You might as well be shooting a gun in a random direction in town square... Maybe someone will die, maybe someone will be hurt, or maybe nothing will happen at all... Life will go on as usual... But there is always the chance... Maybe you will kill someone, maybe not... not a risk I am ever willing to take again...

    • Are you sure you gave the correct BAC here? Anything above .400 is bordering on death, due to heart failure and lack of oxygen.
