Help answer this question below.

I often hear people argue on AB that the government is violating the Constitution by passing a law. However, these people rarely articulate what provision of the Constitution is being violated. Can anyone list some examples of violations?

    Under Texas law you are limited on the places and circumstances you can possess a firearm. You can not carry a firearm on your person unless you obtain a concealed handgun license and even then you are subject to limitations. According to the US Constitution, which supercedes state law, you have the right to bear arms and any law which would infringe on those rights is unconstitutional and therefore null and not law.

    • This is incorrect. The Constitution, when drafted, only applied to the federal government. Some of the Amendmenst have later been applied (i.e. incorporated) to the states by the 14th Amendment. However, the 2nd Amendment was never incorporated to the states. Thus, it does not prevent a state from banning guns.
