Help answer this question below.

I injured my back at work while opening a lift gate that jammed. Been to Dr. & pulled out of work for a week so far. Dr. to re-evaluate tomorrow. Employer sent Family & Medical Leave Act papers instead of filing with Workmans Comp. Legal?

    Workman's comp is there for you when you are hurt on the job. Continue to file your claim. Don't wait, do it ASAP. It sounds like they're trying to find a loop-hole to save face and aviod having to pay. The laws vary state to state. check your state's laws right away and contact the state's Workmans comp center. The state IRS department should be able to give you number's and such if you need help. I know here in Indiana if you are self employed, you apply for a workman's comp waiver through the IRS department. They should be able to direct you to who you need. Phone calls are free, and these people are usually more than happy to help.
