In Virginia, if an employer policy states that half hour breaks can be taken provided you clock out, is it legal to stipulate that you must remain in the building, too?

    If you are to be paid for your time out, and the "clocking out" is only for verifying that you took break.. then YES they can stipulate that you must remain on the property,(building). This is for their insurance purposes. If you are injured while on "company time" then you are specific to your work location.
    Example: If you drove to the nearest burger joint and had a car wreck, the company would be responsible because you were being paid for that time, and you could claim Workmans compensation for that car accident. This is why you are to remain in the workplace, so that any accidents are specific to your work area.
    However, since they require you to clock out, and if you do not have a paid time off, then you are free to go anywhere you want to go as long as you return on time to clock back in.
