Campers in a state forest build a large fire for warmth they forget to turn it off and leave.the wind blows the fire into a brush and ignites fortunally firefighghters were there is this a misdemeanor or felony?

    The scenario you describe sounds like it falls under California Penal Code section 452. It is a "wobbler" (a crime that can be charged as either a felony or a misdemeanor) to unlawfully cause a fire of a structure or "forest land". See Penal Code section 452(c). Just unlawfully causing a fire is a misdemeanor [see Penal Code 452(d)] unless there is injury to another person or someone else's structure, land or property is burned.

    • True about the wobbly part. And if it was an accident I hope the poster gets off lightly. It is just CA is really getting strict. One gal set off an signal fire so her boyfriend would know where she was and it got out of hand...she got in trouble..felony.
