My roommate wants to move out, but our lease doesn't end until July 2007. What are the legal ramifications of her breaking the lease and what is she responsible for?

    actually you are required to attempt to mitigate your damages. even if you try to sue her, since she has given you until december, a judge probably will only give you another month; usually they say three months is long enough to find another renter--as long as she puts out an ad for another roommate, interviews ppl, etc. most landlords will allow another roommate to move in even if they don't allow subletters bc they want their rent.

    • A lease is a contract that is not applicable to a 3 month judgement. It is for the full duration of the contract.
